Prosecutors kick back rape case

YAKIMA - Yakima County Prosecuting attorneys reviewed a rape case that Sunnyside police officers investigated and determined there wasn't sufficient evidence to charge a 33-year-old Prosser man at this time. The man was arrested last week and charged with third degree rape.

The case has been sent back to Sunnyside law enforcement, according to a spokesperson from the Yakima County Prosecuting Attorney's office.

The Prosser man was originally scheduled to be arraigned today (Monday). His 26-year-old brother, who was initially charged with being an accomplice, has not been arraigned either.

Deputy Police Chief Phil Schenck said it is up to detectives whether or not they will continue looking into the case. He said when they receive the report from the prosecuting attorney's office, they will determine if there is more evidence they can collect to support the case.
